1. Definitions
“Seller”: Turf Eagle Limited.
“Buyer”: The purchaser of the Goods, whether a business or a consumer.
“Goods”: The electric maintenance tractor and any attachments, components, or accessories supplied under the Contract.
“Services”: Installation, commissioning, set-up and demonstration of Goods.
“Contract”: The agreement between Seller and Buyer for the supply of Goods (and Services, where applicable) subject to these Terms.
2. Application of Terms
These Terms apply to all sales of Goods by the Seller. Where the Buyer is a consumer, statutory rights under UK, EU or US law apply in addition.
Where the Buyer is a business, consumer protection legislation does not apply. No variation is binding unless confirmed in writing by the Seller.
Acceptance of any quotation or order confirmation constitutes acceptance of these Terms & Conditions, the Warranty document, and the Returns Policy.
3. Product Information
The Seller will supply Goods as described in the Seller’s quotation, order confirmation, or specification sheet. Descriptions, images and brochures are for illustrative purposes only and shall not form part of the Contract.
4. Orders & Acceptance
Orders are subject to written acceptance by the Seller. The Seller may refuse any order at its discretion.
5. Price & Payment
Prices are quoted in GBP (£) exclusive of VAT, duties and international delivery costs unless otherwise stated. Payment terms are as agreed at quotation stage or within any commercial supply agreement. Title to the Goods passes only once payment in full has been received.
6. Delivery, Risk & Services
For UK sales, delivery and set-up are normally included unless otherwise stated. For international sales, delivery and service arrangements are agreed at quotation stage. Risk passes to the Buyer upon delivery.
By accepting these Terms, the Buyer expressly agrees:
“I request that installation, set-up and demonstration Services may begin within the 14-day cooling-off period.
I acknowledge that I will lose my right to cancel these Services once fully performed and agree to pay reasonable costs for any Services performed before cancellation.”
7. Warranty
Goods are supplied with the warranty described in the separate Warranty document provided with each sale. The Warranty document forms part of these Terms.
8. Returns Policy (Summary)
Consumer Sales (B2C):
- 14-day cancellation right applies for distance sales of Goods (except bespoke/customised).
- Services cancellation rights are waived once fully performed.
- Defects must be reported within 7 days.
- Remedies: repair, replace, or refund (last resort).
Non-faulty returns may incur a 25% restocking fee and must be authorised.
Business Sales (B2B):
- No statutory right to cancel.
- Defects must be reported within 7 days.
- Remedies at Seller’s discretion: repair, replace, refund (last resort).
- Non-faulty returns only at Seller’s discretion with 25% restocking fee.
Exclusions: Misuse, neglect, unauthorised repair, or consumables.
9. Liability
The Seller is not liable for loss of profits, business interruption, or indirect/consequential loss. The Seller’s maximum liability is limited to the price paid for the Goods.
10. Force Majeure
The Seller is not liable for delays or failure caused by events beyond its reasonable control.
11. Governing Law & Jurisdiction
This Contract is governed by and construed under the laws of England & Wales. The parties submit to the exclusive jurisdiction of the courts of England & Wales.
12. Entire Agreement
This Contract (including Warranty and Returns Policy) constitutes the entire agreement between the parties. Acceptance of the quotation or placing an order confirms agreement to these Terms & Conditions, the Warranty, and the Returns Policy.
